1. Introduction and Acceptance

These Terms and Conditions govern your use of services provided by everg ois, a senior boarding residence located at Persiaran Tropicana 67, 47410 Petaling Jaya, Selangor, Malaysia. By inquiring about, visiting, or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

2. Definitions

"We," "Us," "Our" refers to everg ois

"Resident" refers to individuals who reside at our facility

"Services" refers to accommodation, meals, activities, and support provided by everg ois

"Agreement" refers to the residence contract entered into between everg ois and the resident or their authorized representative

"Family Member" refers to authorized individuals designated by the resident for communication and decision-making

3. Eligibility and Admission

Residents must be 55 years of age or older. Admission is subject to availability and assessment of whether our services can appropriately meet the individual's needs. We provide boarding and residential services but do not offer medical or nursing care. Individuals requiring ongoing medical supervision should seek appropriate healthcare facilities.

The admission process includes a consultation to understand the prospective resident's needs, preferences, and to determine the appropriate residence level. We reserve the right to decline admission if we determine that we cannot adequately meet an individual's care needs.

4. Services Provided

Standard Services: All residence levels include private accommodation, three daily meals, housekeeping, access to common areas and gardens, and optional participation in activities.

Enhanced Services: Parkside and Premier residence levels include additional services as outlined in the residence agreement and our published materials.

Service Modifications: We reserve the right to modify services with advance notice to residents. Significant changes will be communicated at least 30 days in advance where feasible.

5. Payment Terms

Monthly Fees: Residence fees are due on the first day of each month. Payment can be made by bank transfer, check, or other methods as agreed upon. Late payments may incur additional charges as specified in the residence agreement.

Deposits: A security deposit equivalent to one month's fee is required upon admission and will be refunded after departure, subject to deductions for any damages beyond normal wear and tear.

Fee Adjustments: We reserve the right to adjust monthly fees with 60 days' written notice. Adjustments typically occur annually and reflect increased operating costs.

Additional Charges: Services not included in the standard monthly fee, such as specialized transportation or personal shopping assistance, will be billed separately with prior agreement.

6. Resident Responsibilities

Residents and their authorized representatives agree to:

  • Provide accurate information about health conditions, emergency contacts, and relevant personal details
  • Respect other residents, staff, and visitors
  • Maintain accommodations in reasonable condition
  • Follow facility policies regarding safety, visitors, and shared spaces
  • Communicate any concerns or changing needs to staff
  • Make timely payment of fees and charges
  • Provide notice as specified in the agreement before departure

7. Our Responsibilities

everg ois commits to providing services as described in residence agreements, maintaining a safe and respectful environment, protecting resident privacy and dignity, and addressing concerns in a timely manner.

We will provide advance notice of any significant changes to services or policies and maintain appropriate insurance coverage for the facility.

8. Termination

By Resident: Residents may terminate the agreement with 30 days' written notice. The security deposit will be refunded after final payment and inspection of the accommodation.

By everg ois: We may terminate the agreement with 60 days' notice if the resident's care needs exceed what we can appropriately provide, if there is persistent non-payment of fees, or if behavior poses a safety risk to other residents or staff.

Immediate Termination: Either party may terminate immediately in cases of serious safety concerns or other circumstances as outlined in the residence agreement.

9. Liability and Insurance

everg ois maintains appropriate liability insurance but is not responsible for loss or damage to residents' personal property. Residents are encouraged to maintain their own insurance for valuables and personal belongings.

We are not liable for injuries or losses resulting from residents' own actions or decisions, except where our negligence directly contributed to the harm.

10. Privacy and Confidentiality

We handle personal information in accordance with our Privacy Policy and applicable Malaysian data protection laws. Resident information is kept confidential and shared only with authorized individuals or as required by law. For full details, please see our Privacy Policy.

11. Complaints and Dispute Resolution

We encourage residents and families to communicate concerns directly with staff or management. Formal complaints should be submitted in writing to our administration office.

If a satisfactory resolution cannot be reached through discussion, parties may pursue mediation before initiating legal proceedings. Any legal disputes will be governed by Malaysian law and resolved in the courts of Selangor.

12. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, or public health emergencies. We will make reasonable efforts to continue providing services during such events.

13. Modifications to Terms

We may update these Terms and Conditions periodically. Significant changes will be communicated to residents and families with reasonable notice. Continued use of our services after changes take effect constitutes acceptance of the modified terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
